Hello, everyone, we are team 10C.
Now we will begin our presentation.
Does anyone remember hearing this song?
Yes, this is the song used in the advertisement of Youtube Red.
The 6th of December 2016 was the day the service was launched officially in Korea.
Youtube Red is a charged service that provides video and playlist downloads,
which supports offline, background and/or audio playback.
Its playback styles pretty much overlaps with those of other Korean music websites like
Melon, since Youtube Red's main purpose is to let the users listen to music with minimal
difficulty on Youtube.
But here we ask you a question.
If K-pop is accessible on Youtube, which currently is, why aren't there any copyright issues?
The purpose of this presentation is to answer the question and examine related phenomena.
To talk about Youtube and copyright,
we must first take a look at how Youtube manages copyright issues.
To summarize policies related to K-pop,
1. Music is definitely protected by copyright,
2. Using content without creative commons license is against the policy,
and 3, The process of copyright protection starts whenever a "copyright infringement notification"
is submitted.
Here, the questioned content gets blocked by Youtube.
If the accused party objects and submits a counter notification, the notification is
sent to the accusing party, then the dispute may proceed in court.
This implies that if the original content creator doesn't claim rights in the beginning,
copyright protection doesn't happen in the first place.
Korea was one of the countries that used this policy to their advantage,
leading the so-called "turning point" of K-pop.
Since Youtube was founded in 2005, countless videos such as music videos, stage clips,
broadcasting programs, parodies and covers were uploaded on Youtube.
For example, all 4 TV music programs that feature K-pop singers' performances like
"Music Bank" of KBS, "M Countdown" of Mnet upload clips of their music stage
shows on Youtube voluntarily.
These contents were left untouched by the law, due to lax regulations on copyright that
synergized with the loophole of Youtube's copyright policy.
As time passed, K-pop became well-known to more and more people around the world,
partly because of this relatively abundant amount of related content.
Comparatively, western countries are not that familiar with nationwide weekly music shows.
Even small concerts happen only so often, so content related to music was a scarcity
for them from the start.
Japan, whose broadcasting trends are similar to that of Korea, enforces strict copyright
laws that discourages uploading music on Youtube.
In contrast, Korea tries to keep regulations minimal for advertisement.
For similar reasons, Korean broadcasting companies voluntarily make their Youtube accounts and
are uploading K-pop related videos, as mentioned earlier.
Governmental organizations such as the Ministry of Culture, Sports and Tourism also hosts
cover dance contests and even asks for entertainment management agencies and record companies'
cooperation on not filing copyright claims for the cover dance contest related content on Youtube.
In a sense, K-pop copyright holders had to tolerate copyright violence to some extent.
As much as the lax copyright laws brought prosperity to K-pop, problems such as re-uploading
of illegal and/or pirated content also arose.
This abuse of weak copyright laws will demotivate K-pop producers' will to make quality content,
and in the case of smaller record companies or personal artists, may potentially be fatal
towards their business itself.
Let's hear a piece of music made by an indie band.
Good music, right?
The absence of these small and medium sized projects
will lead to a loss of musical diversity, in which case the government's expectations
of "promotional effects" or "industrial growth" may not be fulfilled and their actions
might undermine development of K-pop in the long-term.
So now, we think it's about time K-pop took copyright issues seriously.
Given the massive range of K-pop fans and the convenience we've enjoyed so far,
it won't be easy to enforce copyright laws rigorously.
Therefore, on a more realistic level, it is necessary to prioritize and respond to the
protection of potential victims of copyright infringement.
Through the improvement of legal measures and social recognition,
we will finally be able to secure the heyday of K-pop
and guarantee the diversity of K-pop by protecting small music producers.
